1. Acceptance of Terms

Your use of VietTube's services constitutes your acceptance of these terms, which may be updated by us from time to time without prior notice. We reserve the right to modify or temporarily or permanently discontinue any part of the service at any time, with or without notice to you or any third party.

2. User Conduct

You acknowledge that all information or data of any kind, whether text, software, code, music or audio, photographs or graphics, videos or other materials ("Content"), publicly and widely shared by you or by the “user whose account has been used” in chat rooms or in areas of the platform that allow you to share content in any format, shall be entirely your responsibility or the responsibility of the user whose account has been used. You acknowledge that our platform may direct you to Content that may be inappropriate or offensive according to your personal judgment. Nevertheless, we shall not be liable to you in any respect for the Content of the website or for any related loss or error.

When using this platform and the services provided, you fully agree that:

You will not infringe upon, break into, access, use, or attempt to infringe upon, break into, access, or use any part of our servers, and/or any data areas without our permission;

You shall not have the right or take any actions intended to restrict or prohibit any other user from using and enjoying the platform;

You will not upload or transmit any information that is illegal, fraudulent, defamatory, insulting, obscene, pornographic, offensive, threatening, abusive, hateful, inciting, etc., or contrary to the general moral standards of society of any kind, including the dissemination or encouragement of conduct that may constitute a criminal offense or violate any provision of local, national, or international law. We respect freedom of expression, but we also reserve the full right to edit, remove, or delete part or all of your posts if we determine that the post or any information submitted violates the above provisions, regardless of whether such violation is explicit or merely implied.

You will not send or transmit any advertising messages, solicitations, chain letters, investment opportunities, or any other form of unsolicited commercial communication, spam, or junk messages;

You will not send or transmit any information or software that you do not own, unless it is freely available software, nor send any information or software containing any type of virus, Trojan, bug, or harmful component;

You will not send, publish, transmit, reproduce, distribute, or exploit in any form any information obtained from VietTube for commercial purposes; nor upload, send, publish, transmit, reproduce, or distribute in any form any content protected by copyright law and VietTube's intellectual property laws; nor create derivative versions of such content without the written consent of the owner or copyright holder.

You have no rights in or to the information provided by VietTube, and you will not use the information on this website in any manner or for any purpose other than those established under these Terms of Use.

You undertake to ensure the lawful use of Content (including but not limited to information, data, etc.) uploaded and posted on the platform.

3. Prohibition of User Access

We have the full right, at any time, to prohibit or deny your access by technical means to VietTube or any part of the platform immediately and without prior notice if we believe that you have violated any provision of these Terms, or if such denial of access is based on our determination that such denial is appropriate and necessary within our authority.

4. Third-Party Information

Information provided on VietTube may contain information from third parties or may be selected by VietTube from other sources. Information on the platform shall not be considered a recommendation for use, consumption, investment, etc., or an endorsement by VietTube of any matter, event, or occurrence, for any purpose, in relation to any person, product, or service.

VietTube shall not be responsible if the information is not updated according to your expectations. The platform is not an independent entity for verifying information and will not recommend any consumer or investment trends. Accordingly, we accept no responsibility for the information we publish; you shall use or rely upon such information with your own knowledge, responsibility, and risk.

5. Links To and From the Platform

Links on VietTube may lead you to other websites, and you acknowledge and agree that VietTube is not responsible for the accuracy or value of any information provided by linked websites.

Links to other websites do not constitute an endorsement by VietTube of the information, products, advertisements, or other materials on those websites.

6. Indemnification

You shall be responsible for civil damages, administrative penalties, and criminal prosecution if you commit acts that violate copyright or related rights. You agree to defend, indemnify, and hold us and VietTube harmless from any legal obligations, proceedings, losses, costs (including unlimited court costs) related to or arising from your violation of any provision of these Terms and/or your use of the platform. We may, where deemed necessary or as required by law, participate in proceedings relating to claims or negotiations for settlement. No settlement may affect our rights or constitute an obligation on our part with respect to any dispute brought and resolved, regardless of whether we appear to participate in the proceedings, unless we have given our prior written consent. We shall have the full right, at our own expense and upon prior notice to you, to assume the defense and control of any claim or proceeding if deemed necessary. However, this right of ours shall not be considered an obligation, including but not limited to the foregoing.

7. Intellectual Property Rights and Other Rights

The intellectual property rights to content posted by VietTube belong to VietTube or are lawfully licensed to VietTube for use. Unless authorized by VietTube, you may not upload, send, publish, reproduce, transmit, or distribute in any form any component of the platform or create modifications of the content provided.

In areas where posting is permitted, you may share permitted information in the formats we provide by default, and you shall be solely responsible for your content, information, images, and any other sharing with individual users or groups of users. However, in all cases, we reserve the right to process posted information in accordance with public customs, ethical rules, and national security rules, and we have full discretion to allow or disallow your posts from appearing or remaining in chat rooms or areas where information sharing is permitted.

We have full rights, including but not limited to copyrights, trademarks, trade secrets, and other proprietary rights that we possess in the platform, the platform's content, and the goods or services provided. The exercise of our rights and ownership must be authorized by us in writing in advance. Except for such written authorization, we grant no license in any other form, whether express or implied, or through allowing you to use the service. Therefore, you have no right to use our platform or services for commercial purposes without our prior written permission.

You agree to allow us to freely use, disclose, apply, and modify any ideas, concepts, methods, proposals, suggestions, comments, or other forms of communication that you provide to us (“Feedback”) relating to VietTube and/or VietTube's services completely free of charge. You waive and agree to waive any rights and claims to any bonuses, fees, royalties, charges, and/or other forms of payment relating to our use, disclosure, application, and/or modification of any or all of your Feedback.

8. Providing Content on the Platform

By providing Content to us:

You agree to grant us all rights and licenses (including moral rights or other necessary rights) to use, display, reproduce, edit, adapt, publish, provide, promote, translate, and create derivative or other composite versions, in whole or in part, worldwide, without requiring compensation. This license applies to any format, medium, or technology currently known or developed in the future; you should note that posts in chat rooms or permitted areas may be stored permanently on our platform.

You warrant that you have all legal, moral, and other rights necessary to grant us the license set forth in this section; You acknowledge and agree that we shall have the right (but not the obligation), to refuse to publish or remove, or prevent access to, any Content you provide at any time, for any reason, with or without notice.

9. Limitation of Liability and Warranties

All information is provided solely for your general reference. VietTube accepts no responsibility for such information.

Your access to and use of the platform are entirely at your own risk and are provided on an “as is” basis. VietTube is intended solely for personal use, and we do not represent or warrant anything, whether expressly or impliedly, including but not limited to any warranty of merchantability or fitness for any particular purpose.

Our entire legal liability lies within the services of VietTube and is limited by law. We do not endorse, guarantee, or warrant any materials, products, or services made available through us or our platform. We are not a party to any transaction between you and any third party.

Under no circumstances shall VietTube be legally liable to you or any person for any loss, whether direct, indirect, incidental, special, or consequential, including business or profit losses, arising from the use of or inability to use information from VietTube, even if VietTube has been advised of the possibility of such losses.

You act and rely entirely on your own skills and ability to assess the use and interpretation of information obtained from VietTube. You are responsible for ensuring that your use of the information complies with all applicable legal requirements.

The limitation of liability under these Terms shall apply to the fullest extent permitted by applicable law.

10. Disclaimer of Warranties

You understand and agree that your use of VietTube and any services or content provided therein (collectively, the "Services") is entirely at your own risk. The Services are provided to you "as is," and we disclaim all warranties of any kind, whether implied or express, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant, whether implied or express, that any part of the Services will be uninterrupted, error-free, free of viruses, timely, secure, accurate, stable, or that any content will be safe for you. You understand and agree that neither we nor the parties involved in providing the Services provide professional advice of any kind, and your use of such advice or any other information is solely at your own discretion, with all associated risks, and is not our responsibility.

12. Applicable Law

You agree that these Terms of Use and any disputes arising from your use of this platform or our products and services shall be resolved under the applicable laws of the Socialist Republic of Vietnam. By registering for or using our platform and services, you implicitly agree to and comply with all provisions of Vietnamese law.

13. Multiple Users

If two or more persons are involved with these Terms as users, they shall share legal responsibilities and rights.

14. Additional Information

In the event that one or more provisions of these Terms of Use conflict with legal regulations and are deemed invalid by a Court, such provision shall be amended to comply with applicable law, and the remainder of the Terms of Use shall remain valid;

The failure of any party to assert or establish its rights under these Terms of Use shall not be deemed a waiver of that party's rights, and such rights shall remain fully valid and effective;

You agree that any claim or proceeding arising from this platform must be filed within one (1) year after such claim or proceeding arises; otherwise, the claim shall be completely invalid;

(iv) We may assign our rights and obligations under these Terms of Use and shall thereafter be released from any obligations arising thereafter.
